Terms of Service
The subscription agreement between Tradie Checkpoint and each business using the operating system.
1. About these Terms
These Terms of Service are a legal agreement between Tradie Checkpoint, ABN 88 547 670 893 (Tradie Checkpoint, we, us or our), and the person or organisation that creates or uses a Tradie Checkpoint account (you or your). They apply to the Tradie Checkpoint website, operating system, mobile and browser experiences, customer links, emails and related services (Service).
If you create an account for a business or another organisation, you confirm that you have authority to accept these Terms for that organisation. References to you include that organisation and its authorised users.
Our address for service is 31 Nighthawk Bvd, South Morang VIC 3752, Australia. Our contact email is hello@tradiecheckpoint.com.au.
2. Eligibility and accounts
- You must be at least 18 years old and able to enter a legally binding agreement.
- Account information must be accurate, current and complete.
- You are responsible for authorised users, protecting passwords and authenticator access, and promptly telling us about suspected unauthorised access.
- You must not share an account in a way that bypasses user limits or security controls.
- We may rely on instructions given through an authenticated account unless we know, or reasonably suspect, that the account has been compromised.
3. Trial, subscription and payment
Tradie Checkpoint Pro is offered as a recurring monthly subscription. New eligible accounts may receive a 14-day free trial. The current price, currency, billing interval, GST treatment and trial end date are displayed before you confirm Stripe Checkout.
Unless you cancel before the trial ends, the payment method provided to Stripe will be charged automatically when the trial ends and monthly after that. Stripe processes payments and stores payment-card details; Tradie Checkpoint does not receive or store your full card number.
- Prices displayed to Australian customers are inclusive of GST unless clearly stated otherwise.
- Promotions or trial eligibility may be limited to new customers and may have additional conditions shown when offered.
- You authorise Stripe to collect recurring charges and applicable taxes for the plan selected.
- A Checkout success page does not activate access by itself. Subscription access is based on a verified Stripe event recorded by Tradie Checkpoint.
4. Renewals, cancellation and refunds
You may manage or cancel your subscription through Settings, the Billing page or the linked Stripe Customer Portal. Unless the Billing page tells you otherwise, cancellation takes effect at the end of the current paid billing period and access continues until that date.
We do not provide a refund merely because you change your mind or do not use the Service. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, remedy or other right that cannot lawfully be excluded under the Australian Consumer Law.
- We will not charge an undisclosed early termination fee.
- If a payment fails, we may display a payment warning and restrict access while the subscription remains past due, unpaid, incomplete or cancelled.
- Where reasonable, you should export records you need before access ends.
- If we make a material adverse change to price or subscription terms, we will give reasonable advance notice and allow you to cancel without a penalty before the change applies.
5. Licence to use the Service
While your account is permitted to access the Service, we grant you a limited, non-exclusive, non-transferable and revocable right to use it for your internal business operations. This licence does not transfer ownership of the Service or its software.
- You must use the Service lawfully and in accordance with the Acceptable Use Policy.
- You must not copy, resell, reverse engineer, scrape or interfere with the Service except to the extent the law expressly permits.
- You must not attempt to access another workspace or defeat authentication, subscription, rate-limit or security controls.
6. Your data
As between you and Tradie Checkpoint, you retain ownership of business records and content you enter or upload, including customer records, quotes, invoices, photos, employee records, expenses and documents (Customer Data). You give us a limited licence to host, copy, transmit, process and display Customer Data only as needed to provide, protect, support and improve the Service, comply with law and follow your lawful instructions.
You are responsible for the accuracy, legality and quality of Customer Data and for having all notices, permissions and consents needed to collect it and provide it to us. You must not upload a tax file number, payment-card number, health record or other highly sensitive information unless a feature expressly requests it.
7. Quotes, contracts, invoices and trade work
Tradie Checkpoint provides workflow and record-keeping tools. It is not a party to a quote, building contract, variation, invoice, employment arrangement or payment agreement between you and your customer, worker, supplier or adviser.
You are responsible for your scope, pricing, customer terms, deposits, licences, insurance, permits, warranties, building-law obligations, GST treatment, payroll decisions, tax reporting and the professional review of documents. Templates, calculations, reminders and suggested workflows are general tools and are not legal, tax, accounting, payroll or building advice.
You must review every quote, invoice, payslip, export, calculation and AI-assisted receipt extraction before relying on or sending it.
8. Electronic communications and acceptance
You consent to receiving account, security, billing and service communications electronically. Customer quote and variation links may record an accepting person’s name, date, time, document details and acceptance status. The Electronic Acceptance Notice explains how this works.
You are responsible for ensuring your customer agrees to use an electronic method and for including suitable customer terms in each quote. Tradie Checkpoint does not guarantee that a particular electronic acceptance is enforceable for every type of work or in every jurisdiction.
9. Third-party services
The Service relies on third-party providers for infrastructure, database and authentication, payments, email delivery, address suggestions and optional receipt extraction. Their services may be subject to their own terms and availability. Our current provider categories are listed in the Subprocessor List.
We are not responsible for a third-party service outside our reasonable control, but this does not limit any responsibility we cannot lawfully exclude.
10. Availability, support and changes
We aim to provide a reliable Service but do not promise uninterrupted or error-free operation. Maintenance, internet failures, provider outages, security events and circumstances outside reasonable control may affect availability.
We may improve, replace or discontinue features. If a change materially reduces the core paid Service, we will give reasonable notice where practicable. Support is available at the contact email shown below.
11. Suspension and termination
We may suspend or terminate access where reasonably necessary to address non-payment, unlawful activity, material breach, security risk, harm to another person or the Service, or a legal requirement. Except for urgent security, legal or abuse issues, we will ordinarily give notice and a reasonable opportunity to fix the issue.
You may stop using the Service at any time. Ending an account does not remove obligations or rights that arose before termination.
12. Data retention and exit
You should export records required for business, tax, employment or legal purposes before cancelling. After an account ends, we may retain Customer Data for a limited period for account recovery, legal compliance, dispute resolution, fraud prevention and secure backup rotation, then delete or de-identify it when no longer reasonably required.
Some records may remain where the law requires retention or where deletion from a protected backup occurs during the normal backup cycle. More detail is provided in the Privacy Policy and Data & Security Terms.
13. Intellectual property and feedback
Tradie Checkpoint and its licensors own the Service, brand, software, design and documentation. You may use generated business documents and exports for your business. If you provide feedback, you allow us to use it without payment or restriction, provided we do not publicly identify you without permission.
14. Consumer guarantees and liability
The Service comes with guarantees that cannot be excluded under the Australian Consumer Law where that law applies. Nothing in these Terms excludes, restricts or modifies a non-excludable guarantee, right or remedy.
To the maximum extent permitted by law, neither party is liable for indirect or consequential loss that was not reasonably foreseeable when the agreement was made. Any permitted limitation will be applied fairly and will not limit liability for fraud, wilful misconduct, breach of confidentiality, infringement of intellectual property, or a liability that cannot legally be limited.
Where the law permits us to limit a remedy for failure to comply with a guarantee relating to services, our liability is limited, at our option, to supplying the services again or paying the reasonable cost of having them supplied again.
15. Your responsibility for misuse
To the extent permitted by law, you are responsible for reasonably foreseeable loss caused by your unlawful use of the Service, material breach of these Terms, infringement of another person’s rights or Customer Data you were not authorised to collect or use. This responsibility is reduced to the extent that our act or omission contributed to the loss.
16. Changes to these Terms
We may update these Terms to reflect legal, security, operational or product changes. We will identify the effective date and give reasonable notice of a material change. If you do not agree to a material adverse change, you may cancel before it takes effect. Continued use after the effective date constitutes acceptance where the law permits.
17. Complaints and disputes
Please first contact hello@tradiecheckpoint.com.au with the business name, account email and details of the issue. We will acknowledge the complaint and try to resolve it in good faith. Nothing prevents either party from seeking urgent relief or using rights available through a regulator, tribunal or court.
18. General
If a provision is invalid or unenforceable, it is read down or severed to the minimum extent necessary and the remaining provisions continue. A delay in exercising a right is not a waiver. You may not transfer this agreement without our consent, which will not be unreasonably withheld. We may transfer it as part of a genuine restructure or sale, provided your rights are not materially reduced.
These Terms are governed by the laws of Victoria, Australia. The parties submit to the courts and tribunals of Victoria and the Commonwealth of Australia.
